Tell that to a cop when he does pull behind you in your driveway, and tells you to get back into the car immediately. lol

procamaroz28 01-25-2008 06:03 PM

na i just ignore him and keep walking to house lol

Camvill 01-25-2008 06:37 PM

I was talking to my friend who's a cop and he says he loves it when people try pulling in their driveway and acting like nothing happened. Then he gets out and basically screams to get bacj in the car.

when i go back to school ill stop by the law library and check if im right about cops not being able to do anything once ur in driveway and they dont got lights on yet b/c once i start turning in he cant put on his lights and expect me to stop thats crazy!!!

Mike 01-25-2008 11:00 PM

dont need to check.... your wrong.

a. they tell you to stay in the car
b. knock on your door.
c. MAIL YOU THE TICKET.

oh by the way. you will get eluding an officer added to the situation

procamaroz28 01-26-2008 08:33 AM

na the thing is cops pull ya over when ur on public roads a big driveway is not a public road he can yell at me it happend to a neighbor but cant actually write a ticket if he puts his lights on as im turning in driveway i gotta confirm this at school

Mike 01-26-2008 09:30 AM

YOU ARE WRONG

GP99GT 01-26-2008 09:42 AM

shouldve pulled into your driveway and pretended you didnt see him shane....run inside, chug a beer but come out with it in your hand so its like you just drank it...then he wouldnt be able to charge you with dwi

Doesn't matter what you are told at school. That is not correct. That would mean that I could race my ass home if a cop is tailing me, pull in the driveway, and say "nyah-nyah you can't get me".

qwikz28 01-26-2008 09:57 AM

come to think of it, i remember when i got pulled over in my friends driveway. and my buddy got pulled over making a sandwich in subway (someone followed us into the parking lot and called the cops on us). neither resulted in a ticket though. i don't believe that jurisdiction thing for a second.

not to sound like a smartass, but what if the policeman didnt see who the person was that ran inside, and there were no witnesses ? then the accused has the right to remain silent, and doesnt have to say anything right? Then if it went to court, plea the 5th?

you can only plead the 5th in federal court IIRC

amargari 01-26-2008 02:32 PM

Definitely talk to a lawyer about this. I was in traffic court a few weeks ago (not for me, I was rear ended and was a witness for the state) and the judge mentioned that there is a case before the supreme court on whether the Breathalyzer exam is legit. Apparently all cases could be thrown out if this is found to be the case.
