worker's compensation laws are a completely different animal. and, btw, if he settled for 1k, either he had a dufus for a lawyer or he got robbed. lost time at work alone is worth more than 1k. ask me how i know (i haven't worked since 2003, on social security which is a pittance, waiting for the case to settle - it's a subject that interests me so i studied it at length)...
personal injury, especially in an automobile, does not have the restrictions that worker's compensation does... basically, there is no limit, even though the insurance companies make you sign that higher tort threshold. even still, with two of them hurt and losing time at work, they will burn through that threshold very quickly.
i still say you should be considering a suit. at least go talk with a
reputable lawyer (i do know of two, who are
very good, but one works out of Princeton, and the other in Forked River, which is just north of Barnegat, so you might want to look in your area for one).
