Legally, if you had enough time and money on your hands, you could sue him for it...

I'm not at my computer at home right now, but I am on a law forum and I know a great thread on sellers not following through with selling...

However, bottom line.. you're S.O.L. unfortunately. You could take him to court and MAKE him sell it to you, but that just wouldn't be worth the time or money.
