Loud exhaust ticket?!?!
Im driving around town and a cop pulls me over because i was stopped to long at a stop sign because i was talking to my friend which i guess was kinda suspicious...but anyway he also says my exhaust is WAY to loud!!
thats insane, granted it was 2 in the morning but its just a flowmast american thunder...i have the cat and the stock manifolds....it is NOT loud at all..
i told him that the kit is 50 states legal but he didnt care so is there anyway i could get a printed document from the website or anywhere that states that it is a legal system because i am not about to convert back to stock!

i think its cause motorcycles are considered weekend rides that are rarely driven. cars are considered daily drivers. it doesn't make sense but thats my guess.

Find out what the actual statute is, and what the guidelines are. There has to be somewhere in writing what a loud exhaust actually is (ie 90 db at 100 ft perpendicular to the exhaust at 3000 rpm)

I don't know that an actual decibel limit is defined anywhere. 198ESP just went through this for state inspection at Baker's Basin and upon failing for a loud exhaust asked what the criteria are and where they could be found. None were provided to him and he was told it is discretionary. Hopefully he'll see this thread and chime in on the specifics, but he put up a fight and basically was fed a bunch of crap when I last talked to him.

Another reason why NJ and it's corrupt police suck. Last I read in GM High Tech April 2008 there is no law stating a decibel limit. It just basically says that an exhaust system needs to be in good working order and can not have an exhaust cut out. Check it out for the exact wording.
I am still a firm believer that loud pipes save lives....

Sounds pretty subjective to me.....I also thought that they had adopted SAE J1169:
Quote:
The SEMA model provides for the testing of vehicle exhaust noise to a standard adopted by the Society of Automotive Engineers (SAE) with an established noise limit of 95-decibels (SAE J1169). Under the SAE standard, a sound meter is placed 20 inches from the exhaust outlet at a 45 degree angle and the engine is revved to three quarters of maximum rated horsepower. The highest decibel reading is then recorded.

Inspection is different from the law on which tickets are based. James had the same issue with inspection with his loudmouth catback and bullet muffler. But it's below the decibel limit of all towns (each town and/or county has different decibel limits).
You could try to fight it, but it'll cost you more in court fees/lawyer fees etc than the ticket is worth.
It's similar to a ticket for "exhibition of speed". It's bogus, but you can't beat it, and if you do, the financial cost isn't worth it.

54 dollars upfront and be done with it.
Or take it to court to fight it, risking that you have to pay the $30.00 some fees on top of that and miss work and sit in a crowded hot boring courtroom. ANd if you get a lawer add fees to that.
I would just take it like a kick in the nuts and pay it unfortunetly. It's BS but think about how much more expensive taxes would be if bullcrap tickets like that werent given out!!!

You think thats bad they told me that my V6 was told loud. But i proved the cop wrong. I said one i have a cat, two i have a muffler, 3 i have no ehaust leaks, I asked the cop where in his rule book it states he can just tell me that my car is to loud, he told me he didnt have it but my exhaust was still to loud, so i asked if he could prove to me that my exhaust has exceded 95d at from 2 feet behind my car at 2,000rpm and he said no i will just giv you a warning. I have been hearing more and more people getting pulled over for this, most eople dont realize the cop must prove you have exceded the 95dbat 3/4 your maxium rated horsepower to give you a ticket. The same goes for NJ inspection, if they dont have the proper equipment to show that your car has exceded the 95db, then they must pass you. No where in the rule does it say someone can just say by word of mouth your car is to loud.

Did you read all the responses to this? NJ hasn't (to any of our knowledge) adopted the SAE testing standard. The law is quoted in my post above.
If you have different info, please share your source......

current NJ law:
N.J. Stat. @ 39:3-70 (2002) [Mufflers]
Every motor vehicle having a combustion motor shall at all times be equipped with a [muffler] in good working order and in constant operation to prevent [excessive or unusual noise and] annoying smoke, AND NO PERSON SHALL MODIFY THE EXHAUST SYSTEM OF A MOTOR VEHICLE IN A MANNER SO THAT THE EXHAUST SYSTEM EMITS IN EXCESS OF NINETY-FIVE DECIBELS AS MEASURED BY THE SOCIETY OF AUTOMOTIVE ENGINEERS (SAE) STANDARD J1169 ( May 1998 ). IT SHALL NOT BE A VIOLATION OF THIS SUBSECTION UNLESS PROVEN BY PROPER AUTHORITIES THAT THE EXHAUST SYTEM MODIFICATION RESULTS IN NOISE AMPLIFICATION IN EXCESS OF NINETY-FIVE DECIBELS UNDER THE PRESCRIBED SAE TEST STANDARD.
A COURT MAY DISMISS ANY ACTION FOR WHICH A PERSON IS PROSECUTED FOR OPERATING A VEHICLE IN VIOLATION OF THIS SUBSECTION IF IT IS FOUND THAT THE DEFENDANT HAD REASONABLE GROUNDS TO BELIEVE THAT THE VEHICLE WAS NOT OPERATED IN VIOLATION OF THIS SUBSECTION.
[and] n No person shall use a [muffler] cut-out, bypass or similar device upon a motor vehicle on a highway.

That right there tells you they can fail you for excessive or unusual noise and it's subjective. The 95 decibel part is for aftermarket exhaust systems to put an obvious limit on that.

I think i've only ever had one cop tell me he thought my exhaust was too loud. Every other time my exhaust was mentioned, it was usually the cop telling me it sounded good, and then talking about either their own car or someone they knew having a similar car (this is in one of teh 2nd gens i mean). guess I just get the good cops. I even got away with doing a burnout in a parking lot once, because I was honest about it

I read this as two separate clauses to the law:
current NJ law:
N.J. Stat. @ 39:3-70 (2002) [Mufflers]
[CLAUSE 1]
Every motor vehicle having a combustion motor shall at all times be equipped with a [muffler] in good working order and in constant operation to prevent [excessive or unusual noise and] annoying smoke,
AND
[CLAUSE 2]
NO PERSON SHALL MODIFY THE EXHAUST SYSTEM OF A MOTOR VEHICLE IN A MANNER SO THAT THE EXHAUST SYSTEM EMITS IN EXCESS OF NINETY-FIVE DECIBELS AS MEASURED BY THE SOCIETY OF AUTOMOTIVE ENGINEERS (SAE) STANDARD J1169 ( May 1998 ).
Therefore, if either clause 1, which is admittedly subjective in nature, or clause 2 is satisfied, then the law has been broken.
On a side note, if you're rolling around at 2am in the morning with a loud Camaro, you're kind of asking for it.
Please don't misconstrue my response as a flame or a defense for police or anything. Many on this board (especially Tru2Chevy) can tell you my general disdain for law enfocement. I'm just looking at the law through my legal eyes.
