If they sent out an appraiser then they most likely have something in the works.

Did they say if the plan was to cut you a check and total the car out or repair? Or is that still a pending question as well?

Not really. When one party is clearly at fault the insurance companies will try to avoid getting sued for max payout. Remember, liability as far as traffic offenses is vastly different than when in court for a lawsuit. Since the driver that hit the Camaro was clearly at fault when hitting a parked car and fully insured, the insurance company is on the hook for any lawsuit finding that is within the payout threshold.

They simply do the math and make the decision, it is worth cutting a check for 30k-ish for the car or risking paying out the probably 50-100k that is common on full coverage policies?

If the car should have not been on the road, the accident would have never happened. An uninsured vehicle should not be on the road. Luckily, it appears he did have coverage via the dealer plate's liability insurance. But yes, it does come down to the bottom line.

Right. My comment is moot because of the dealer plate but an uninsured car shouldn't be there. So any accident involving one can be argued that it wouldn't have happened had the car not been there

You can actually get away with rear ending someone in this situation.

Probably the only time you could rear end someone and not be at fault.

Furthermore it's probably not stored in accordance with Hagerty's rules and it's not a Class 1 car according to the paperwork.

Wsex, go buy some lottery tickets!

i am assuming the other driver's insurance is paying since she is at fault.

Then wouldn't they go by actual cash value?

Its great to say nothing would have happened had the car not been there but I know someone who got a nice check from someone's insurance company when they tried to use that argument in court. Don't confuse traffic law with a lawsuit.

The contention to the negative is invalid on it's face anyway, the Camaro had a dealer plate on it. Dealer plates are registration and insurance for short term transit. So even if the classic car policy that had been applied for wasn't in place yet there was a policy on the car making it legal to park on the street.

unregistered/uninsured could jeopardize a claim, but that is not the case here it seems. so moot point. but yes that could in theory cause problems.

yes, the drivers ins company is not obliged to any agreed value. if hagerty pays anything up to their agreed limit they will seek reimbursement from the other company.

Also seeing how the car wasn't in the inventory of a used car dealer (unless this thread about you owning it is nonsense) it could put that dealer in a sticky situation.

I read everyone's response.
I don't mind going to court....
I do want max payout.

The plate was a temp plate. It's all legit.

Yes. and you can laugh but this camaro was very very well kept. Long story short
The first allstate offer is very low. Mind you I'm in the green I won't lose any money I have invested. But I want more. I explained it all to hagerty and believe it or not they have an appraiser to go check the car on Monday.

So at that point hagerty will determine what should be done.
The damages are in upwards of 12k$ that's not even with every single nos part. Just the major things. And that's not including if frame is twisted etc.

About the cobra
I have a strong connect with a finiance company. Car was a repo took a Month to get title transfered to my name. But 8500 for a 28k mile termi? Hellooo

And off subject
I have info on repo of
A 69 camaro ss 18k original miles for very very cheap
53 vette in red
67 vert maro in yellow
And 70 judge orange

Pm if interested

Must be the only one like it. No one in their right mind would paint a 53 Corvette red.
